A colleague recently e-mailed me wondering if the casino credit department had to comply with the “Red Flags Rule.” The answer is not an easy one, but the facts are below. To the best of my knowledge, neither the National Indian Gaming Commission (NIGC) nor the Nevada Gaming Control Board (NGCB) has issued a mandate for compliance. But personally, I’m not waiting for a mandate, because I think it is just good, sound business sense to be proactive and comply with this relatively new law.
